1. Acceptance

By accessing or using this website you agree to these terms. If you do not agree, do not use the site. These terms apply to the website only; financing transactions are governed by the term sheet, loan agreement, fee agreement and other documents executed for that transaction, which control over anything on this site in the event of a conflict.

2. Informational purpose

The content here is general information about commercial and business purpose financing. It is not an offer, a commitment, a solicitation in any jurisdiction where that would be unlawful, or advice of any kind: legal, tax, accounting, appraisal or investment. 3. Eligibility and permitted use

You must be at least 18 and capable of forming a binding contract. You agree not to use the site to submit false, misleading or fraudulent information; to submit information about a person or entity without authority to do so; to seek financing for a property you or a family member occupy as a residence; to scrape, harvest or bulk-download content; to interfere with the operation or security of the site; or to use any content to train a machine learning model without our written permission.

4. Submissions

Submitting a form does not create a loan application, a commitment, an obligation or a relationship of agency, fiduciary duty or confidentiality beyond what our privacy policy provides. We may decline to respond to or act on any submission for any lawful reason. You represent that information you submit is accurate and that you have the right to provide it, including any information about third parties.

5. Intellectual property

The site and its content, text, design, layout, graphics and code, are owned by Matador and its licensors and are protected by copyright and other laws. The Matador name, the bull mark and the Matador logotypes are trademarks of Matador Lending LLC and may not be used without written permission. You may view, download and print pages for your own internal business use, provided you do not remove any notice. All other rights are reserved.

Links to third-party websites are provided for convenience. We do not control, endorse or assume responsibility for their content, products, policies or practices.

7. No warranty

The site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. Market information, program terms and illustrative figures change constantly and may be out of date at the moment you read them.

8. Limitation of liability

To the fullest extent permitted by law, neither Matador nor its affiliates, members, officers, employees or agents will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost opportunities, lost data or business interruption, arising out of or relating to your use of this site, whether based in contract, tort, strict liability or otherwise, even if advised of the possibility. Our aggregate liability arising out of or relating to the site will not exceed one hundred dollars ($100).

9. Indemnity

You agree to indemnify and hold harmless Matador and its affiliates from any claim, loss, liability or expense, including reasonable attorneys’ fees, arising out of your use of the site, your breach of these terms, or information you submit.

10. Governing law and venue

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. The exclusive venue for any dispute relating to the website is the state or federal courts located in Harris County, Texas, and you consent to their jurisdiction. Dispute resolution for a financing transaction is governed by the loan documents for that transaction, which may provide for arbitration.

11. Changes

We may modify these terms at any time by posting a revised version. Continued use after posting constitutes acceptance. We may also change, suspend or discontinue any part of the site without notice.

12. Severability and entire agreement

If any provision is held unenforceable, the remainder stays in force. These terms, together with the privacy policy and disclosures, are the entire agreement between you and Matador with respect to the website.
