Disclosures
What Matador Funding is, what it is not, and the rules that govern the loans described on this site.
Last updated 2026
1. Business purpose lending only
All loan products described on this website are extended solely for business, commercial or investment purposes. They are not consumer credit.
Specifically, we do not originate, broker, arrange or service any loan that is:
- secured by a dwelling that the borrower, or any member of the borrower’s family, occupies or intends to occupy as a principal residence or second home;
- made primarily for personal, family or household purposes; or
- used to refinance consumer debt that was itself incurred for personal, family or household purposes.
Because these loans are made for business purposes, they are exempt from the Truth in Lending Act and Regulation Z, the Real Estate Settlement Procedures Act, the TILA-RESPA Integrated Disclosure rules, the ability-to-repay and qualified mortgage requirements, and comparable state consumer mortgage statutes. Borrowers do not receive a Loan Estimate or a Closing Disclosure, and the protections those regimes provide do not apply.
Every borrower executes a business purpose certification at closing, and we independently verify occupancy and intended use. A loan obtained by misrepresenting the purpose or occupancy of the property is a default and may constitute fraud.
If you are seeking financing for a home you intend to occupy, our affiliate Matador Lending originates consumer residential mortgages under the full set of consumer disclosures and protections.
2. Two different roles
Matador Funding operates in two distinct capacities, and which one applies to your transaction affects who your counterparty is and how we are compensated.
As a lender
On the direct programs described under Hard Money, available on Texas property only, we or an affiliated lending entity may be the lender of record, funding the loan from our own or affiliated capital, including capital of the Matador Note Fund. In that capacity we are your counterparty, not your agent, and we are acting in our own interest. Our compensation is the origination fee, interest and other charges disclosed in the loan documents.
As a broker
On the programs described under Commercial, we act as a mortgage broker arranging financing from third-party lenders. We are not the lender, we do not make credit decisions, and no lender is obligated to approve or fund your request. Our compensation is a brokerage fee, which is disclosed in the fee agreement and on the closing statement, and which may be paid by you, by the lender, or by both. We may receive compensation from more than one source on a transaction; all such compensation is disclosed before closing.
We may also refer transactions to affiliated entities. Any affiliated business arrangement is disclosed to you in writing, and you are never required to use an affiliate as a condition of financing.
3. Not a commitment to lend
Nothing on this website constitutes an offer, a commitment, a pre-approval or a guarantee of financing. All rates, advance rates, leverage limits, loan amounts, fees and terms shown are illustrative ranges for well structured transactions with qualified sponsors. They are not available to every applicant, they vary by property, market, program, borrower and transaction, and they are subject to change at any time without notice.
Every transaction is subject to full underwriting, satisfactory third-party reports (which may include appraisal, environmental assessment, property condition assessment, feasibility study, survey and title), acceptable insurance, entity and background review, legal documentation and final credit approval. A binding obligation to lend arises only upon execution of a written loan agreement and related loan documents. A term sheet is an expression of interest on stated terms and conditions, not a commitment, unless it expressly states otherwise.
4. Fees
We do not charge an application fee and we do not require an upfront diligence deposit in order to review a transaction. Once a term sheet is accepted, the applicant is responsible for the cost of third-party reports, which are paid directly to the vendors providing them. Origination points, brokerage fees and the administrative fee are payable at closing. All fees applicable to your transaction are itemized in the term sheet and in the closing statement.
5. Licensing
Business purpose lending and commercial mortgage brokerage are regulated differently in each state. Certain states license or otherwise regulate business purpose lending, commercial mortgage brokerage or both; others do not. We conduct business only in states where we are appropriately licensed or exempt, and the availability of any program depends on the location of the property and the nature of the transaction.
Direct lending is limited to Texas. Loans that Matador Funding underwrites and funds from its own or affiliated capital, the programs described under Hard Money, are made only on real property located in the State of Texas. Commercial mortgage brokerage is available nationally, subject to state law and to the requirements of the lender ultimately selected.
Matador Funding, a division of Matador Lending LLC. Certain business purpose transactions are funded or arranged through affiliated or licensed third-party entities; the entity acting in your transaction is identified in your loan documents.
Matador Funding does not originate consumer mortgage loans. NMLS identifiers belonging to its consumer-mortgage affiliate are not applicable to, and are not held out in connection with, the business purpose transactions described on this site.
[State-specific licence numbers and required state disclosures to be inserted following licensing review.]
6. Fair lending, business credit
The Equal Credit Opportunity Act and Regulation B apply to business credit. Matador Funding does not discriminate against any applicant on the basis of race, color, religion, national origin, sex, marital status, age (provided the applicant has the capacity to contract), because all or part of the applicant’s income derives from a public assistance program, or because the applicant has in good faith exercised any right under the Consumer Credit Protection Act.
An applicant for business credit whose application is denied may request the reasons for that denial. The request must be made within 60 days of our notification, and we will provide the reasons within 30 days of receiving the request. The federal agency that administers compliance with this law concerning this creditor is the Federal Trade Commission, Equal Credit Opportunity, 600 Pennsylvania Avenue NW, Washington, DC 20580.
7. No offer of securities
References on this website to the Matador Note Fund, to balance-sheet capital or to affiliated private credit vehicles describe the source of lending capital only. They are not an offer to sell, or the solicitation of an offer to buy, any security, fund interest, note or other investment. Any offering of securities by an affiliate would be made only to eligible investors, pursuant to definitive offering documents, and in compliance with applicable securities laws. Nothing on this site should be construed as investment advice or as a recommendation to acquire any interest in any fund.
8. No legal, tax, accounting or investment advice
The content of this website is general information about financing structures. It is not legal, tax, accounting, appraisal or investment advice, and it does not take account of your particular circumstances. Real estate investment involves risk, including the loss of principal. Projections of after-repair value, rents, occupancy, construction cost, absorption or exit pricing are estimates and are frequently wrong. You should consult your own attorney, accountant and advisors before entering into any transaction.
9. Third-party reports and valuation
Appraisals, broker price opinions, environmental assessments, property condition reports and feasibility studies are prepared by independent third parties. We do not direct, influence or coerce any valuation professional as to the value reached. Where you pay for a report, a copy is provided to you. A valuation obtained for one lender or program may not be usable by another.
10. Communications, texting and recording
By submitting a form on this website or otherwise providing your contact information, you consent to being contacted by Matador Funding and its affiliates by telephone, email and text message at the number and address you provide, including through automated dialing systems and pre-recorded or artificial voice messages, regarding your inquiry and our services. Consent is not a condition of obtaining credit. Message and data rates may apply; message frequency varies. Reply STOP to opt out of text messages or HELP for assistance. You may withdraw consent at any time by contacting us. Telephone calls may be monitored or recorded for quality and training purposes.
11. Forward-looking and illustrative content
Example transactions, sample structures and illustrative arithmetic shown on this site are for explanation only. They do not describe any specific borrower or transaction, are not a representation that any particular result will be achieved, and are not indicative of past or future performance.
12. Accessibility
We aim to make this website usable by everyone, including users of assistive technology. If you encounter a barrier, please tell us at hello@matadorfunding.com and we will work to provide the information you need in an accessible form.
13. Reporting fraud
If you believe someone has used the Matador name or branding to solicit fees from you, do not send funds. Contact us directly at (713) 555-0142 to verify before acting. We never request wire instructions by unsecured email and we never change wire instructions by email.
